Effective Dates
Overview
Effective dates determine when VA disability pay begins and ends, establishing when service-connection protections activate. They're generally based on when the VA receives your claim, though various situations can result in earlier or later dates.
BLUF: Your effective date = your payday. File an Intent to File NOW and lock in today's date. Every day you wait is money left on the table. The VA won't remind you—consider this your reminder.
Two Absolute Rules
- Cannot be before the date entitlement arose
- Cannot occur during active duty service
These rules cannot be overcome under any circumstances.
Key Payment Notes
- The month of your effective date you are NOT paid — compensation starts the following month
- Benefits are paid one month in arrears
- Example: File June 1 → Benefits start July 1 → Payment received end of July
Main Effective Date Categories
Date Entitlement Arose
Only applies when evidence clearly shows entitling criteria weren't met when claims were filed. This acts as a hard stop for effective dates. Medical conditions with objective diagnostic criteria (diabetes, hypertension, chronic kidney disease) commonly trigger this rule.
Separation from Active Duty
Claims received within one year of separation can receive effective dates starting the day after separation for conditions that began or worsened during service. The character of discharge must not be dishonorable.
Intent to File (ITF)
When you tell the VA you plan on submitting a claim/appeal, the ITF remains active for one year. Generally provides the earliest possible effective date by allowing dates up to a year before claim receipt.
ITFs cannot be applied to: - Dependent claims - Higher Level Reviews - Board appeals
ITF Validity: If the anniversary falls on a weekend or holiday, filing the next business day keeps it valid.
Increase Claims
Medical evidence can support effective dates up to one year before filing an increase claim, demonstrating the disability warranted higher evaluation at that earlier time.
Secondary Conditions
For diabetes and spine-related nerve issues, secondary conditions can receive effective dates consideration like increase claims.
Appeals
Appeals can use ITFs filed within one year prior (under certain conditions).
National Guard and Reservists
Special effective date considerations apply for part-time service members.
Liberalizing Changes of Law
When VA rating schedules change favorably, new effective dates may apply.
TDIU
Specific effective date rules govern Total Disability Individual Unemployability claims and awards.
Hospitalizations
38 CFR 4.29 governs effective dates related to hospital admissions.
Special Monthly Compensation (SMC)
Special rules apply for SMC and special monthly pension effective dates.
Character of Discharge Upgrades

- Staging: Multiple effective dates possible if conditions' severity changes during processing
- Combining Claims: Administratively combined claims retain their original received dates

- Requesting Earlier Dates: Veterans can request earlier effective dates with supporting evidence
Important Notes
- Effective date determinations can be VERY complicated — consider filing a Higher Level Review if errors occurred
- Lack of formal diagnosis doesn't automatically disqualify claims with documented symptoms
- Extensions to filing deadlines occasionally apply during natural disasters or VA technical failures
