Overview

The Forever GI Bill (Harry W. Colmery Veterans Educational Assistance Act of 2017) eliminated time limits for most veterans.

Current Rules:

Separation Date Post-9/11 GI Bill Montgomery GI Bill
On or after Jan 1, 2013 NO EXPIRATION 10 years from separation
Before Jan 1, 2013 15 years from separation 10 years from separation

Pro Tip: If you separated after January 1, 2013, your Post-9/11 GI Bill benefits NEVER expire. You can use them at any point in your life. This was a major change from the Forever GI Bill passed in 2017.

For veterans whose benefits DO have expiration dates, extension opportunities exist for qualifying circumstances.

Eligibility for Extension

The VA will extend GI Bill benefits in four specific scenarios:

  1. Disability or Illness — A condition prevented benefit usage; no service-connection requirement
  2. Returned to Active Duty — Called back for at least 90 continuous days while using benefits
  3. Foreign Government Detention — Held by foreign power after final military service
  4. Rudisill Supreme Court Decision — Those with multiple service periods who waived Montgomery benefits

Critical requirement: Except for Rudisill cases, qualifying circumstances must occur before expiration.

Requesting an Extension

General Process

Veterans must mail evidence copies to their Regional Processing Office.

Documentation Requirements

Disability/Illness: - Personal letter explaining condition, prevention reasons, and specific dates (mm-dd-yyyy format) - Employment details if applicable (job type, employer, hours) - Medical documentation with diagnosis, treatment timeline, and supporting test results

Active Duty Return: - Simple extension request letter - Active Duty orders or DD214 copy covering 90+ days

Foreign Detention: - Situation statement with detention dates - Supporting evidence

Rudisill Decision: - Complete VA Form 22-1995 online, selecting Rudisill review on page two - Note: Automatic review applies for those using benefits after August 15, 2018 - Deadline for recalculation: October 1, 2030

Alternative Option

Those unsuccessful with extensions should explore Veteran Readiness and Employment, which permits higher education pursuit among other vocational options.
